Return Policy & Consumer Terms

Article 1: Applicability

This Return Policy and these Consumer Terms apply to all purchases made by consumers from Novelty Coffee, whether online through our website or offline in our physical stores.

Article 2: Right of Withdrawal

Consumers have the right to withdraw from this contract within 14 calendar days without giving any reason.

The withdrawal period expires 14 calendar days after the day on which the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the goods.

To exercise the right of withdrawal, the consumer must notify Novelty Coffee by means of a clear statement (for example by email or letter). The consumer may also use the standard EU withdrawal form, although its use is not mandatory.

Article 3: Effects of Withdrawal

If the consumer withdraws from this contract, we will reimburse all payments received from the consumer, including the cost of our least expensive standard delivery option (excluding any additional costs resulting from the consumer choosing a different delivery method), without undue delay and no later than 14 calendar days after being informed of the consumer's decision to withdraw.

We may withhold reimbursement until we have received the returned goods or until the consumer has supplied evidence of having returned the goods, whichever occurs first.

Refunds will be made using the same means of payment used for the original transaction unless the consumer has expressly agreed otherwise. No fees will be charged as a result of the reimbursement.

The consumer must return the goods without undue delay and no later than 14 calendar days after notifying us of the withdrawal. The deadline is met if the goods are dispatched before the 14-day period expires.

Article 4: Return Costs

Unless otherwise agreed, the consumer bears the direct cost of returning the goods.

Article 5: Exceptions to the Right of Withdrawal

In accordance with applicable consumer protection legislation, the right of withdrawal does not apply to:

  • Goods made to the consumer's specifications or clearly personalised.

  • Goods liable to deteriorate or expire rapidly.

  • Sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed after delivery.

  • Sealed food products once opened.

  • Goods which, after delivery, become inseparably mixed with other items.

As Novelty Coffee primarily sells freshly roasted coffee and other food products, these exceptions may apply to products that have been opened, unsealed or are otherwise no longer suitable for resale due to their perishable nature.

Article 6: Condition of Returned Goods

Consumers are liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

We recommend returning goods in their original packaging where possible. The absence of the original packaging alone does not automatically prevent a refund, although any reduction in value caused by unnecessary handling or damage may result in a corresponding deduction from the refund.

Order Cancellation

Orders may be cancelled free of charge before they have been dispatched.

Once an order has been dispatched, consumers may exercise their statutory right of withdrawal in accordance with this Return Policy.

Payment

Payment must be made according to the payment method selected during checkout or any agreed payment terms.

Ownership of the goods remains with Novelty Coffee until payment has been received in full.

Delivery

We will arrange delivery to the address provided by the customer during checkout or to another address agreed between the parties.

Delivery dates and transit times are estimates only and are not guaranteed.

We are not liable for delays caused by events beyond our reasonable control or by incorrect or incomplete delivery information supplied by the customer.

If the recipient is unavailable during delivery, the carrier may redirect the parcel to an authorised pickup location in accordance with its delivery procedures.

Where a parcel is made available at an authorised pickup location, delivery shall be deemed completed when the parcel is available for collection.

Customers are responsible for ensuring that the delivery address provided is accurate and suitable for receiving parcels.

If a parcel is lost during transit, we will investigate the shipment with the carrier and, where appropriate, replace or refund the order in accordance with applicable law.

Delivery prices and estimated transit times vary depending on destination.

Inspection of Goods

Consumers should inspect the goods upon delivery and notify us as soon as reasonably possible if goods are damaged, defective or incorrectly supplied.

This does not affect the consumer's statutory rights relating to defective or non-conforming goods.

Faulty or Incorrect Goods

If goods are defective, damaged during transport or incorrectly supplied, consumers are entitled to the remedies available under applicable consumer protection legislation.

Where a return results from our error or from defective goods, Novelty Coffee will bear the reasonable cost of return shipping.

Risk and Ownership

Risk in the goods passes to the consumer when the goods are delivered into the physical possession of the consumer or a third party designated by the consumer.

Ownership of the goods remains with Novelty Coffee until full payment has been received.

Limitation of Liability

Nothing in these Terms excludes or limits any rights that consumers have under applicable consumer protection legislation.

To the fullest extent permitted by law, Novelty Coffee shall not be liable for indirect or consequential losses, loss of profit, loss of business or losses resulting from circumstances beyond our reasonable control.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot lawfully be excluded.

Communications

Any notices relating to orders or this Return Policy should be made in writing by email or post using the contact details provided above.

Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control.

No Waiver

Failure by either party to enforce any provision of these Terms shall not constitute a waiver of that provision or of any future breach.

Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Greece.

Consumers continue to benefit from any mandatory consumer protection provisions applicable in their country of residence where required by law.

Consumer Dispute Resolution

Consumers residing in Greece may contact the Greek Consumer Ombudsman for the out-of-court resolution of consumer disputes where applicable.

Novelty Coffee is not obliged and does not commit to participate in dispute resolution proceedings before a consumer arbitration board unless required by applicable law.

Language

These Terms are available in both Greek and English.

In the event of any discrepancy or inconsistency between the two versions, the Greek version shall prevail.

Statutory Rights

Nothing in this Return Policy or these Terms limits or excludes any rights that consumers are entitled to under applicable consumer protection legislation.
